SMS Terms & Conditions

1. Purpose of This Document

This SMS Terms & Conditions document (“SMS Terms”) governs WOWAITECH’s text messaging program, operated by NextGen Online Inc.. It explains who can join the program, exactly how to opt in, what you will receive, exactly how to opt out, and how consent records are kept. It is designed to be read on its own, at its own URL, independent of our general Privacy Policy — which governs broader data handling.

By opting in to receive text messages from WOWAITECH through any of the methods described in Section 4, you agree to these SMS Terms.

2. The SMS / Text Messaging Program

WOWAITECH uses SMS text messaging to communicate with prospective clients, current clients, and consulting contacts about:

  • Appointment scheduling, confirmations, and reminders
  • Order, purchase, and subscription confirmations
  • Customer support responses
  • With separate marketing consent only: new automation bundles, promotions, and events

Messages are sent using Twilio and/or Zoom messaging infrastructure on WOWAITECH’s behalf. WOWAITECH, not Twilio or Zoom, is the sender and is responsible for program compliance.

3. Eligibility

  • You must be 18 years of age or older to opt in.
  • You must be the account holder or authorized user of the mobile number provided.
  • This program is intended for U.S. mobile subscribers on supported carrier networks (Section 10).

4. How to Opt In

Consent must be affirmative, clear, and specific to text messaging — it is never bundled with, or required as a condition of, any purchase. The following are the only valid opt-in pathways:

4.1 Website Form Opt-In

On any contact, booking, or checkout form, an unchecked checkbox is presented with language substantially similar to:

The box must be checked by the user — it is never pre-checked by default.

4.2 Keyword Opt-In

A visitor may text a designated keyword (e.g., JOIN or START) to WOWAITECH’s published SMS number to opt in directly.

4.3 Verbal or Written Consent During a Call or Consultation

During a sales call, free audit, or consulting session, a team member may ask for and record verbal or written consent to send text messages. The number, date, time, and method of consent are logged per Section 11.

4.4 Consent as Part of a Paid Engagement

Where SMS updates are a disclosed, describable part of a purchased service (e.g., appointment reminders for a booked consulting session), providing a mobile number at checkout with the SMS notice visible constitutes opt-in for those transactional messages specifically — not for marketing messages, which always require separate consent.

5. Confirmation Message

Immediately after a successful opt-in, WOWAITECH sends a one-time confirmation message:

Message frequency may vary based on your engagement with WOWAITECH. You may receive more messages during an active project or fewer during periods of inactivity.

7. Message and Data Rates

Message and data rates may apply based on your mobile carrier plan. WOWAITECH does not charge for text messages beyond what is disclosed at checkout for any paid service — the messaging program itself is free to join, but standard carrier rates apply to any SMS/MMS you send or receive.

8. How to Opt Out

You may opt out at any time using any of the following methods:

  • Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any message from WOWAITECH.
  • Contact us using Section 15 and request removal from the program.
  • Ask a WOWAITECH team member during any call to remove your number.

Upon receiving an opt-out request, WOWAITECH will send one final confirmation message and no further messages, except as required by carrier guidelines:

If you opt back in later (Section 4), you are treated as a new subscriber and will receive a fresh confirmation message.

9. Getting Help

10. Carrier Disclaimers & Supported Carriers

  • Carriers are not liable for delayed or undelivered messages.
  • Supported carriers include, but are not limited to: AT&T, T-Mobile, Verizon, U.S. Cellular, and other major U.S. carriers.
  • Carrier coverage and delivery are not guaranteed for every device or plan.

11. Consent Record-Keeping

For every opt-in, WOWAITECH records and retains:

  • The mobile phone number.
  • Date and timestamp of consent.
  • Method of consent (web form, keyword, verbal, or checkout).
  • For web form opt-ins: the IP address and the exact checkbox language displayed at the time of consent.
  • Any subsequent opt-out request and its date/timestamp.

These records are retained as long as necessary to demonstrate compliance with applicable law, even after a number has opted out, and serve as WOWAITECH’s proof of consent in the event of a dispute.

12. No Sharing of Opt-In Data

No mobile information or SMS opt-in consent is shared with any third party or affiliate for their own marketing or promotional purposes — under any circumstance.

Text messaging originator opt-in data and consent are used solely to operate WOWAITECH’s own messaging program as described in this document, and are exempt from any broader data-sharing terms in WOWAITECH’s general Privacy Policy.

13. Changes to This Program

WOWAITECH may update these SMS Terms, the message types sent, or frequency from time to time. Material changes will be posted at this document’s URL with an updated Effective Date, and, where required, existing subscribers will be notified before the change takes effect.

14. Relationship to Our Privacy Policy

These SMS Terms work alongside WOWAITECH’s general Privacy Policy, which governs how we collect, use, and protect personal information more broadly, including information collected through this messaging program. Where this document and the Privacy Policy overlap on SMS-specific matters, this document controls.

16. Regulatory Basis

This program is designed to operate consistent with the U.S. Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and applicable carrier (10DLC / toll-free) requirements. It does not constitute legal advice, and compliance depends on WOWAITECH’s actual implementation matching what is described here.
